Are Psilocybin Spores Legal?

The fact that psilocybin spores are not illegal may come as a surprise to many people. Although the legal aspects surrounding psilocybin are likely to change over time, given the attention that scientific researchers are currently paying to the potentially beneficial effects of psilocybin on human health, it is pretty clear that the spores can be legally sold and purchased on various types of markets, including the online environment.

Mushroom spores represent some microscopic organisms that have reproductive purposes. They can be compared to the seeds of a plant because they contain genetic data and make mushrooms grow.

The thing about mushroom spores is that they do not yet contain psilocybin, and because of that, they are not illegal. Psilocybin is only present in the mushrooms when they get to germinate and produce mycelia. In most states, it is legal to buy and sell psilocybin spores for research and educational purposes.

But we need to note that there are some states, such as Idaho or Georgia, where the commercialization of psilocybin mushroom spores is explicitly forbidden. Oregon was the first American state which decriminalizes the possession of psilocybin. And there are some other regions, such as Denver, Detroit, Ann Harbor, etc., where psilocybin is decriminalized.
