The legality of the psychedelic substance psilocybin, as well as the “magic” mushrooms that produce it, together with their spores, has been a hotly debated topic for quite a while. The question that many people want to ask is, why is it that magic mushrooms themselves are illegal in many parts, while the psilocybin mushroom spores are actually legal to own, send through the mail and travel with?

The first thing you have to know is that, just because it’s a general fact that in most cases psilocybin spores are not illegal, that doesn’t make it universally true. In fact, there are a few jurisdictions, such as those in California, Idaho and Georgia, where the legislation actually prohibits the sale of psilocybin mushroom spores. Also, the growing of magic mushrooms is seen as drug manufacturing in some areas, so the prohibitions there are quite heavily enforced.

Nevertheless, that being said, much of the legislature in the United States actually allows psilocybin spores, as well as products like magic mushroom spore syringes – which don’t perpetuate the sale and use of the active compound, psilocybin. Their legality is simply based on the fact that the spores themselves don’t contain psilocybin until they are grown into full-size mushrooms. At that point, they of course, become illegal to own, use or sell.
